Datenschutzerklärung
1. Verantwortlicher
Rechtsgrundlage ist deine Einwilligung (Art. 6 Abs. 1 lit. a DSGVO).
Privacy Policy
This is a courtesy translation. The German version above is legally authoritative; in case of any discrepancy, the German text applies.
1. Data Controller
Tariverdiyev Elman (PhasePilot), Maarstraße 67, 52499 Baesweiler, Germany
Email: info@phase-pilot.de
A Data Protection Officer has not been appointed, as there is no obligation to do so under Article 37 of the GDPR (no extensive or systematic processing of special categories of data or profiling, and the company does not have a sufficient number of employees).
2. Principle: Your app data remains on your device
MyOpening Lab stores all your content, including repertoires, games, training progress (repeat count), and settings, exclusively locally on your device, in the browser database (IndexedDB) or in the app's local storage. This content is never transferred to me as the data controller or to third parties; there is no dedicated server for this purpose and no cloud synchronization. If you delete the app or the browser data, your saved content will also be permanently deleted (the app offers a dedicated backup feature in the settings: "Back up all data as a file"). One exception is the evaluation query described in section 5: the board position currently shown leaves your device, but neither your repertoire nor your training progress or settings.
3. Website Hosting (Server Log Data)
This app is provided and hosted as a web application via Netlify, Inc. (San Francisco, USA). As with every website visit, Netlify automatically processes technical connection data, specifically your IP address, the date and time of access, and browser/device information (server log files). This is technically necessary to deliver the content to your device.
The legal basis is Article 6(1)(f) of the GDPR (legitimate interest in the functional and secure delivery of the app). Since Netlify is based in the U.S., this may involve data transfer to a third country outside the EU/EEA; Netlify uses the Standard Contractual Clauses published by the European Commission or the EU-U.S. Data Privacy Framework to ensure an adequate level of data protection. Details: netlify.com/privacy. If the app is downloaded via the Google Play Store, Google's own privacy policy also applies to the download process itself (account, payment processing, device management). I have no control over this.
4. No Tracking Without Consent, No Cookies, No Advertising, No Sale of Your Data
By default, the app does not use any analytics or tracking services, advertising networks, or cookies for marketing or statistical purposes. Your usage behavior is not analyzed unless you actively switch on the voluntary, anonymous usage statistics described in section 11. I have not sold your data to third parties or shared it for marketing purposes in the last twelve months, and I will not do so in the future, if only because, apart from the cases mentioned in this policy (hosting, Play Store, optional usage statistics), I technically do not have any data from you that I could share.
5. Network queries for evaluations and the Opening Explorer
The position evaluation and the Opening Explorer query public, free Lichess services (game database statistics and cloud evaluation) for the position currently shown. Only the current board position (FEN) is transmitted to lichess.org, meaning the bare arrangement of pieces, no personal data and nothing from your repertoire. The query is read-only and happens only when you have switched on the evaluation or the explorer. Evaluations you have retrieved are stored locally on your device so the same position does not have to be requested again; you can delete this store at any time in the settings. Without an internet connection, only the evaluations already stored are available. The legal basis is Art. 6(1)(f) GDPR (legitimate interest in being able to offer an evaluation feature without running my own servers). Lichess's privacy policy applies to these queries.
6. Pro Subscription via Google Play & Right of Withdrawal
The optional Pro feature is offered as a subscription via Google Play Billing (7-day free trial, followed by automatic monthly renewal; can be canceled at any time via Google Play). The contracting party for this purchase is Google (Google Commerce Limited, Gordon House, Barrow Street, Dublin 4, Ireland) as the "Merchant of Record," not me as the app provider. Payment processing, cancellation, and the statutory consumer rights associated with this purchase (including the 14-day right of withdrawal for distance contracts) are governed by the Google Play Terms of Service. No payment is required during the 7-day trial period.
7. Minors
The app is not specifically intended for children. Since virtually no personal data is processed (Section 2), use by minors is not a concern from a data protection perspective. Google Play's own age requirements apply to the purchase of the Pro subscription.
8. Retention Period
Your app data (Section 2) remains stored until you delete it yourself or clear the app/browser data. The hosting server log data (Section 3) is automatically deleted in accordance with Netlify's standard retention periods; Netlify, as the separate controller responsible for this logging, specifies the exact time limits; see their privacy policy.
9. Storage Without Consent (Section 25(2) TDDDG)
The local storage of your repertoires, games, and settings on your device is technically essential for the app to function at all (the actual purpose of the service). According to Section 25(2) TDDDG, no separate consent is required for this, therefore a cookie banner is not provided.
10. Your Rights
Under the GDPR, you have the following rights: right of access (Art. 15), right to rectification (Art. 16), right to erasure (Art. 17), right to restriction of processing (Art. 18), right to data portability (Art. 20), and right to object to processing (Art. 21): simply contact me via email (Section 1). For your app data (repertoires, games, settings), you can also exercise these rights yourself at any time and immediately, without contacting me: Export via Settings → "Back up all data as a file," complete deletion via Settings → "Delete all data," since this data is stored exclusively on your device and is never available to me, I have no access to or control over it.
You also have the right to file a complaint with a data protection supervisory authority (Art. 77 GDPR), e.g.,
with the authority responsible for my place of business:
State Commissioner for Data Protection and Freedom of Information North Rhine-Westphalia (LDI NRW),
Kavalleriestraße 2–4, 40213 Düsseldorf, ldi.nrw.de/kontakt.
If you use the app outside the EU (e.g., in the United Kingdom, Switzerland, the United States, or Canada), you may be entitled to additional, comparable rights under your respective local laws. Since I do not store any personal data about you, the easiest way to exercise any of these rights is to contact me directly via email (Section 1). I have deliberately chosen not to use a separate procedure via an external service provider.
11. Optional, anonymous usage statistics
In addition to the technically necessary data flows described above, you can voluntarily switch on anonymous usage statistics (Settings → "Anonymous usage statistics", default: off). It helps me see which features of the app are actually used, so I can improve it in a targeted way.
Only a small, fixed list of event names is recorded (e.g. "training started", "PGN imported", "analysis opened", "onboarding completed", "paywall shown", "trial button tapped", "purchase completed", "daily goal met", "rating submitted", "notification tapped") along with the platform (web, Android, or iOS). NO content is ever transmitted: no repertoire name, no board position, no training progress, no settings, and no other free text. This restriction is technically enforced, not just promised: the code only allows these fixed event names at the point where data is sent.
For some of these events, a single, likewise fixed additional property is sent, never free text: for example where a purchase-related action originated (onboarding, a locked feature, or settings) or the number of stars (1 to 5) given in a submitted rating. This too is technically enforced: the code only allows these fixed, hard-coded values at the point where data is sent, never your own text or numbers.
Service: Aptabase (aptabase.com), an open-source analytics tool, operated via its EU region. Aptabase does not require any identifier from the app; according to its own documentation, the service derives a short-lived hash server-side from IP address, browser identifier, and a value re-generated daily, which makes events impossible to link across more than a day. This app itself additionally generates only a purely in-memory, non-stored session ID, which is discarded every time the app restarts.
The legal basis is your consent (Art. 6(1)(a) GDPR). Because this is an access to your device that, unlike the local storage described in section 9, is NOT technically required for the app to function, Section 25(1) TDDDG additionally applies: without your consent, this access does not take place. Consent is voluntary, obtained separately from the notification question, and can be withdrawn at any time with future effect in the settings, without any disadvantage to you.
12. Feedback form
If you give 1 to 3 stars on the rating page, or choose "Report a bug" or "Suggest an idea" in settings, you can voluntarily write in a text field. If you tap "Submit" there, the app tries to forward this text (with the star rating too, for a rating) together with the app version and the platform directly to my mailbox, without running my own server for it. Only what you yourself entered in the field is transmitted, plus the star rating (if any), app version, and platform. You are not asked for your name or email address, and neither is transmitted.
If no recipient can be reached at that moment (no internet connection, or the service does not respond), the app instead opens a pre-filled email in your own mail program, which you send yourself; in that case no data is transmitted to the service named below, only a normal email to me.
Service: Formspree, Inc. (San Francisco, USA), a form-forwarding tool with no storage of its own beyond the mere forwarding. Since Formspree, Inc. is based in the USA, this may involve a data transfer to a third country outside the EU/EEA. I do not have an individually verified adequacy guarantee for this service (e.g. an EU-US Data Privacy Framework certification), unlike Netlify (section 3); details on how Formspree handles data can be found in its own privacy policy: formspree.io/legal/privacy-policy. Only the voluntarily entered short text (with a star rating, if any), app version, and platform is affected, never your repertoire, your training progress, or your settings.
The legal basis is your consent through actively tapping "Submit" (Art. 6(1)(a) GDPR), alternatively Art. 6(1)(b) or (f) GDPR (handling your request addressed to me, or my legitimate interest in being able to receive feedback without running my own server). Use is entirely voluntary: the text field only appears if you submit a rating of 1 to 3 stars or choose "Report a bug"/"Suggest an idea", and you can cancel at any time without entering any text.
13. Changes to This Statement
If the app is expanded to include features that process data differently (e.g., server synchronization), this statement will be updated accordingly in advance. In the event of any discrepancies between the German and English versions, the German version shall prevail.
Effective: September 2026 (usage statistics expanded, feedback form added).
