Allgemeine Geschäftsbedingungen (AGB)

1. Geltungsbereich

BGB).

12. Kontakt

Fragen zu diesen AGB beantworte ich gerne per E-Mail: info@phase-pilot.de (vollständige Anbieter-Angaben siehe Impressum).

Terms of Service

This is a courtesy translation. The German version above is legally authoritative; in case of any discrepancy, the German text applies.

1. Scope

These Terms of Service apply to the use of the "MyOpening Lab" app (web/PWA version and the version distributed via the Google Play Store), offered by Tariverdiyev Elman, Maarstraße 67, 52499 Baesweiler, Germany (full details in the Imprint). By using the app, you agree to these Terms.

2. Description of Services

MyOpening Lab is chess opening training software: creating and managing repertoires, spaced-repetition training using the SM-2 method, and, in the private full version, game analysis with a chess engine. The free tier allows one repertoire and normal training. An optional subscription ("Pro") adds unlimited repertoires, weakness- and variation-focused training, training statistics, and an adjustable repetition schedule. This is pure software, not a personal coaching or advisory service.

3. Formation of Contract

The free feature set is available simply by installing or opening the app, without registration and without a separate contract with me. For the optional Pro subscription, the contract is formed through the Google Play Billing purchase process. The contracting party for this purchase is Google (Google Commerce Limited, Gordon House, Barrow Street, Dublin 4, Ireland) as the "Merchant of Record," not me as the app provider (see Privacy Policy, Section 6, for details). If the app is obtained via the Apple App Store, the purchase is accordingly made through Apple (Apple Distribution International Ltd., Hollyhill Industrial Estate, Hollyhill, Cork, Ireland); Apple's terms of service then apply to the purchase process. Because the app works without a user account and without a server of my own, a Pro subscription applies only to the platform it was bought on: a subscription purchased from Google cannot be restored on an Apple device, and vice versa.

4. License to Use

You receive a simple, non-transferable right to use the app personally. Not permitted: reverse engineering beyond what is mandatorily allowed by law, redistribution or resale of the app or its content, and any form of automated abuse (for example, scripts that deliberately overload third-party servers such as Lichess through the app).

You are responsible for any content you bring into the app yourself (for example, imported PGN files or Lichess studies): this content stays exclusively on your device and is neither viewed nor reviewed by me. You ensure that you are entitled to use it and that it does not infringe the rights of others, for example copyright in a commercial opening course.

5. Your Data, Your Responsibility for Backups

All content, meaning repertoires, games, and training progress, is stored exclusively locally on your device (see Privacy Policy, Section 2, for details). There is no account and no cloud backup on my part. You are responsible for creating backups yourself on a regular basis (Settings → "Back up all data as a file"). If you delete the app or your browser data without a prior backup, your content is permanently lost. I have no access to it and cannot restore it.

6. Availability, Content, and Warranty

The app is provided "as is." There is no claim to continuous availability, error-free operation, or fitness for a particular purpose. Training content originates from sources you import yourself (PGN files, Lichess studies) or from the bundled sample repertoire; I make no warranty as to the chess accuracy of imported or bundled opening theory. I reserve the right to further develop, change, or discontinue features.

7. Liability

I am liable without limitation for intent and gross negligence, and for breach of material contractual obligations (obligations whose fulfillment is essential to the proper use of the app and on whose compliance you may regularly rely); in the case of breach of material contractual obligations, liability is limited to foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded. Liability for damage to life, body, or health, and liability under the Product Liability Act, remain unaffected. I am not liable for data loss resulting from the absence of your own backup (Section 5).

8. Pro Subscription, Cancellation, Withdrawal

After the 7-day free trial, the Pro subscription automatically renews monthly until canceled. Cancellation, payment processing, and statutory consumer rights (including the 14-day right of withdrawal for distance contracts) are governed exclusively by Google Play's terms of service, since Google is the contracting party for this purchase (Section 3). Cancellation is handled exclusively through Google Play (Play Store app → Subscriptions), not through me as the app provider.

9. Consumer Dispute Resolution

I am not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board (Section 36 of the German VSBG).

10. Final Provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Should any provision of these Terms be invalid, the validity of the remaining provisions is unaffected. Changes to these Terms will be published here; I will additionally notify you in the app of material changes.

11. Minors, Legal Capacity

The free feature set can be used regardless of age, since practically no personal data is processed (see Privacy Policy). Entering into the paid Pro subscription is additionally subject to Google Play's own age requirements; minors need the consent of their legal guardians for the contract to be validly formed (Sections 107 et seq. of the German Civil Code, BGB).

12. Contact

I'm happy to answer questions about these Terms by email: info@phase-pilot.de (full provider details in the Imprint).

Effective: September 2026.
